By law, a wrongful death is when an individual dies due to the carelessness or negligence of another individual, group of individuals, corporation, etc., or by any one person or group of people given the lawful authority to make decisions or resolutions separate from an owner.

Some of the common causes for a “wrongful death” include:

  • Car/truck accidents
  • Boating accidents
  • Unsafe working conditions
  • Medical malpractice
  • Dental malpractice
  • Dangerous drugs/prescriptions
  • Airline accidents
  • Cruise ship accidents

Our wrongful death attorneys at Kamerow Law have won large settlements in wrongful death compensation lawsuits for our clients.

In determining the amount of compensation our clients should rightfully be given, the following factors are considered:

  • Medical bills incurred for the deceased
  • Pain and suffering the deceased incurred while still alive
  • Loss of future income by the deceased
  • Loss of companionship
  • Emotional distress
  • Funeral expenses

In most cases, recovering damages for the loss of a loved one is limited to the immediate family such as the spouse, and surviving children of the deceased.  In addition, surviving parents of dependent and adult children may also qualify for wrongful death compensation.

In most states, there are laws requiring wrongful death lawsuits to be filed within a two-year timeframe after the death of a loved one.  It is critical to meet with an attorney as quickly as possible if you believe the loss of your loved one was caused by carelessness or negligence by an entity or another individual.
